Fiscal Cliff Talks Continue As Senate Leaders Reach For Last-Minute Deal

WASHINGTON -- Senate leaders groped for a last-minute compromise Saturday to avoid middle-class tax increases and possibly prevent deep spending cuts at the dawn of the new year as President Barack Obama warned that failure could mean a "self-inflicted wound to the economy."

Obama chastised lawmakers in his weekly radio and Internet address for waiting until the last minute to try and avoid a "fiscal cliff," yet said there was still time for an agreement. "We cannot let Washington politics get in the way of America's progress," he said as the hurry-up negotiations unfolded.

For all the recent expressions of urgency, bargaining took place by phone, email and paper in a Capitol nearly empty except for tourists. Alone among top lawmakers, Senate Republican leader Mitch McConnell spent the day in his office.

In the Republicans' weekly address, Sen. Roy Blunt of Missouri cited a readiness to compromise. "Divided government is a good time to solve hard problems ? and in the next few days, leaders in Washington have an important responsibility to work together and do just that," he said.

Even so, there was no guarantee of success, and a dispute over the federal tax on large estates emerged as yet another key sticking point alongside personal income tax rates.

In a blunt challenge to Republicans, Obama said that barring a bipartisan agreement, he expected both houses to vote on his own proposal to block tax increases on all but the wealthy and simultaneously preserve expiring unemployment benefits.

Political calculations mattered as much as deep-seated differences over the issues, as divided government struggled with its first big challenge since the November elections.

Speaker John Boehner remained at arms-length, juggling a desire to avoid the fiscal cliff with his goal of winning another term as speaker when a new Congress convenes next Thursday. Any compromise legislation is certain to include higher tax rates on the wealthy, and the House GOP rank and file rejected the idea when he presented it to them as part of a final attempt to strike a more sweeping agreement with Obama.

Lawmakers have until the new Congress convenes to pass any compromise, and even the calendar mattered. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up and then vote to cut taxes after they had risen.

Nor was any taxpayer likely to feel any adverse impact if legislation is signed and passed into law in the first two or three days of 2013 instead of the final hours of 2012.

Gone was the talk of a grand bargain of spending cuts and additional tax revenue in which the two parties would agree to slash deficits by trillions of dollars over a decade.

Now negotiators had a more cramped goal of preventing additional damage to the economy in the form of higher taxes across the board ? with some families facing increases measured in the thousands of dollars ? as well as cuts aimed at the Pentagon and hundreds of domestic programs.

Republicans said they were willing to bow to Obama's call for higher taxes on the wealthy as part of a deal to prevent them from rising on those less well-off.

Democrats said Obama was sticking to his campaign call for tax increases above $250,000 in annual income, even though he said in recent negotiations he said he could accept $400,000. There was no evidence of agreement even at the higher level.

There were indications from Republicans that estate taxes might hold more significance for them than the possibility of higher rates on income.

One senior Republican, Sen. Jon Kyl of Arizona, said late Friday he was "totally dead set" against Obama's estate tax proposal, and as if to reinforce the point, Blunt mentioned the issue before any other in his broadcast remarks. "Small businesses and farm families don't know how to deal with the unfair death tax_a tax that the president and congressional leaders have threatened to expand to include even more family farms and even more small businesses," he said.

Several officials said Republicans want to leave the tax at 35 percent after exempting the first $5 million in estate value. Officials said the White House wants a 45 percent tax after a $3.5 million exemption. Without any action by Congress, it would climb to a 55 percent tax after a $1 million exemption on Jan. 1.

Democrats stressed their unwillingness to make concessions on both income taxes and the estate tax, and said they hoped Republicans would choose which mattered more to them.

Officials said any compromise was likely to ease the impact of the alternative minimum tax, originally designed to make sure that millionaires did not escape taxation. If left unchanged, it could hit an estimated 28 million households for the first time in 2013, with an average increase of more than $3,000.

Taxes on dividends and capital gains are also involved in the talks, as well as a series of breaks for businesses and others due to expire at the first of the year.

Obama and congressional Democrats are insisting on an extension of long-term unemployment benefits that are expiring for about 2 million jobless individuals.

Leaders in both parties also hope to prevent a 27 percent fee cut from taking effect on Jan. 1 for doctors who treat Medicare patients.

There was also discussion of a short-term extension of expiring farm programs, in part to prevent a spike in milk prices at the first of the year. It wasn't clear if that was a parallel effort to the cliff talks or had become wrapped into them.

Across-the-board spending cuts that comprise part of the cliff were a different matter.

Republicans say Boehner will insist that they will begin to take effect unless negotiators agreed to offset them with specified savings elsewhere.

That would set the stage for the next round of brinkmanship ? a struggle over Republican calls for savings from Medicare, Medicaid and other federal benefit programs.

The Treasury's ability to borrow is expected to expire in late winter or early spring, and without an increase in the $16.4 trillion limit, the government would face its first-ever default. Republicans have said they will use administration requests for an extension as leverage to win cuts in spending.

Ironically, it was just such a maneuver more than a year ago that set the stage for the current crisis talks over the fiscal cliff.

EFF: Limit Software Patents - Patent Law Blog (Patently-O)

Since the Supreme Court?s 2010 Bilski ruling, the Federal Circuit has been consistent on only one point in its ? 101 jurisprudence?and that?s on being inconsistent. In the face of the Federal Circuit?s failure to provide a workable ? 101 standard, the Supreme Court issued its unanimous ruling in Mayo v. Prometheus, essentially telling the Federal Circuit to take the patentable subject matter inquiry seriously. Yet the Federal Circuit paid no heed when it issued ruled in CLS Bank v. Alice, all but ignoring the Supreme Court (for many of us court watchers, the Federal Circuit?s failure to address Mayo was shocking; even Judge Prost, in her dissent, admonished the majority for ?fail[ing] to follow the Supreme Court?s instructions?not just in its holding, but more importantly in its approach.?).

So it really was no surprise when the Federal Circuit agreed to take CLS en banc. We, along with many others, hope that this case would provide the Court an opportunity to head the Bilski Court?s warning that:

The Information Age empowers people with new capacities to perform statistical analyses and mathematical calculations with a speed and sophistication that enable the design of protocols for more efficient performance of a vast number of business tasks. If a high enough bar is not set when considering patent applications of this sort, patent examiners and courts could be flooded with claims that would put a chill on creative endeavor and dynamic change. (130 S. Ct. at 3229).

As currently interpreted, ? 101 leaves parties unable to discern a patent?s metes and bounds or assess its validity, making inadvertent infringement an unfortunate cost of doing business. This has led to a dangerous and dramatic increase in patent litigation, particularly surrounding business method patents or those covering software. For better or worse (and I think worse), the major uptick in these cases involved non-practicing entities. Some data that we included in our amicus brief filed in CLS Bank:

  • From 200-2002, NPE litigation accounting for only about five percent of patent litigation;[1] in 2007 that figure was 22 percent and in 2011 it was 40 percent.[2]
  • Litigation surrounding software patents has also greatly increased:

  • For the first time in 2011, spending by both Apple and Google on patents exceeded the firms? spending on new product research and development.[4]
  • NPEs now disproportionately target small companies; at least 55% of unique defendants sued by NPEs make under $10 million a year.[5]

These statistics are a direct result of the legal instability surrounding ? 101. One way to stem this problem is to create incentives for those facing litigation (or litigation threats) to pursue their meritorious defenses of noninfringement and invalidity. Section 101 could play that role, in fact, the Mayo Court seemed to state as much: ?to shift the patent-eligibility inquiry entirely to these late sections [??102, 103, 112] risks creating significantly greater legal uncertainty, while assuming that those sections can do work that they are not equipped to do.? 132 S. Ct. at 1304.

?Yet no version of recent ? 101 jurisprudence offers much hope of settling the law. Instead, we recommended in our brief (filed along with Public Knowledge) that the Federal Circuit take another route and adopt a stricter construction of ? 112(f), as recently proposed by Prof. Mark Lemley. Specifically, instead of attempting to figure out whether a broad, functional claim is abstract or not, a court may first use ? 112(f) to narrow the claim to the structures and their equivalents recited in the patent and then, if questions remain, make a ? 101 inquiry. ?

?While ? 112(f) has traditionally been applied to apparatus claims, it?s clear that Congress intended it to apply to method claims as well. Despite this, software patents often do not detail actual algorithms or explain how to actually carry out the methods they attempt to claim; as such they should be indefinite under cases like Aristocrat Techs. v. Int?l Game Tech. If the claims do specify the algorithms, then the ? 101 inquiry will be limited to those algorithms and their equivalents. These questions?of whether ?112(f) applies; if it does, how the claims should be limited; and then if ? 101 permits that narrowed claim?could all be accomplished at early stages of litigation, before expensive discovery and motion practice.

ECB's Nowotny cautiously optimistic about 2013

VIENNA (Reuters) - Measures taken this year by policymakers to address the economic crisis in the euro zone allow for cautious optimism regarding 2013, European Central Bank ratesetter Ewald Nowotny said on Friday.

Nowotny welcomed the launch of a permanent rescue fund for struggling euro zone countries, a framework for common bank supervision by the ECB, and a deal to continue supplying aid to Greece.

"Altogether these are important measures that allow for cautious optimism for a way out of the crisis in 2013," Nowotny said in a statement.

His stance chimed with comments on Thursday by German Finance Minister Wolfgang Schaeuble, who said in a newspaper interview the worst of the debt crisis appeared to be over.

Both men also stressed the need for euro zone states to stick with tight fiscal policies.

Schaeuble said he was optimistic France would press on with its efforts to stop its debt burden expanding.

Nowotny, who also heads Austria's central bank, said the government in Vienna needed to bring down its public debt level, which he expected to rise to 75 percent of gross domestic product next year.

"In the eyes of the central bank this level is clearly too high. It is therefore crucial to continue pushing for consolidation," he said. "We hope that this path will not be abandoned in 2013, an election year."

Nowotny also said he expected Austrian inflation to fall below 2 percent in the next two years amid signs of an economic upturn.

Schaeuble said he expected Germany's economy to expand at a decent rate next year, underpinned by exports to countries outside the euro zone.

Lots of erstwhile challenges and obstructions have been done away with by the advance of technology. The advent of the laptop or computer has put ownership of a business within the reach of regular individuals. Not only does the internet have a lot of products to sell, but there is ample information online to show you how to sell them. The very best way to start a business on the internet, is to find someone who has a business model you like, and pattern yours after theirs.

Instead of a fulltime business you could just be after an additional income stream, which the Internet caters for handsomely. Paragon Backup & Recovery 12 Home


Paragon Software's disk management tools routinely outclass the competition and run away with our Editor's Choice?for example Paragon Hard Disk Manager Suite 2011. I expected Paragon Backup & Recovery 12 to perform equally well, but I wasn't nearly as impressed by it as I am by Paragon's disk tools. Paragon Backup & Recovery 12 Home ($39.95, direct) gets basic backup jobs done, and offers a far cleaner interface than its more-powerful rival Acronis Backup & Recovery, but its interface prevents non-experts from using some essential features. Worse, in my tests under Windows 7 64-bit, Paragon's app was the only backup program that crashed in the middle of routine operations. It didn't crash predictably, but it crashed more than once?and even one crash is one too many for a backup program.

Getting Started
When Paragon Backup & Recovery starts up, it offers a simple menu with "Smart Backup" and "Restore" as the most prominent options. Smaller icons lead to other tools, including Paragon's reliable tools for copying drives and partitions and extracting multiple files from disks or backups for storage elsewhere. An unobtrusive link at the foot of the screen opens Paragon's advanced interface, which lets expert users access the enormous range of features that Paragon builds into its products. I'll get back to the advanced interface later, after surveying the app's consumer-level features.

The Smart Backup option on the main menu leads to a wizard that lets you choose among a full range of backup types, from backups of full disks and partitions through backups of Outlook or Windows Mail messages, media files, documents, or any arbitrary set of files and folders. Clear menus let you specify whether to perform the backup once or on a recurring schedule, whether to password-protect a backup, and an option to create a script file in Paragon's proprietary scripting language that can be saved and reused?but only from the Windows command line or via the optional advanced interface.

The consumer-level interface lets you create backup jobs that can run on a schedule, but it gives the non-expert user no way to save a backup job that can be run once but also reused later. This is an essential consumer-level feature that backup apps from Acronis, NTI, and Genius all provide, but which Paragon makes available only to experts.

Performance
When I tested the app's ability to save an 800 MB folder to a USB3 drive, it took a whopping five minutes to do the job, compared to Acronis's 84 seconds. Worse, it twice crashed with an error message without completing the operation, though in each case it performed successfully when I ran the backup a second time. This simply shouldn't happen with software that's designed to safeguard your data.

Other tools available on the consumer-level interface include a feature that builds bootable recovery media on either optical or USB flash disks. The disk-building interface is blissfully simple, and the resulting recovery media is the essentially the same easy-to-use, powerful recovery disk created by Paragon's hard disk management apps. It's the one recovery disk that I've always got available, and it's never failed me yet.

Options
Another tool on the consumer-level interface creates and manages "Backup Capsules," which are optionally-bootable secure partitions like the "Acronis Secure Zone" that is one of rival Acronis's features. I didn't test this feature for two reasons. First, I think it's a mistake to save your data on the same physical hard disk with the data itself, because any damage to the hard disk is likely to wipe out the backup. Second, I know from hard experience that it's potentially dangerous to alter your disk structure with a proprietary bootloading code that only one vendor's applications can manage or understand. Fortunately, as with Acronis's Secure Zone, you don't need to use Paragon's Backup Capsules.

To return to the app itself, the optional advanced interface offers a genuinely dazzling range of features, entirely unlike the deliberately-hobbled consumer-level interface of the main menu. You get Paragon's spacious, detail-rich display of disk information and lucid wizards for building backup jobs and disk management tasks. The advanced features include the ability to combine two or more existing backup archives, each from a different partition or folder, into a single archive. You can also create and reuse the full range of simple, differential, or incremental backups that are standard in all advanced backup programs. Unfortunately, I experienced the same program crash when I ran a folder backup from the advanced interface that I did when I ran it from the consumer-level interface.

Paragon Backup & Recovery 12 Home, like Acronis Backup and Recovery, is an enormously powerful program with a less-than-ideal interface. Paragon's consumer-level interface is too limited. Acronis' interface is more complex than I'd like it to be but at least it makes all major features relatively easy to find and manage. Acronis also has a major advantage in its greater reliability?at least in my testing?and also in its optional online storage feature. Acronis edges out Paragon for Editors' Choice in local backup software.

(AP) ? Syrian rebels fully captured a northern town near the Turkish border on Tuesday after weeks of siege and heavy fighting, activists said.

The takeover of Harem, a town of 20,000 in northern Idlib province, was the latest in a string of recent rebel successes that include the capture of wide areas along the border with Turkey. Most of those areas have been in northern Aleppo province, where anti-government forces have captured at least three large military bases.

The Britain-based Syrian Observatory for Human Rights said the rebels captured Harem in the early hours of Tuesday. Mohammed Kanaan, an Idlib-based activist, said the last post to be taken was the historic citadel, which overlooked the town. The army had turned the citadel into a military post.

"Harem is fully liberated now," Kanaan he said via Skype. He added that as the rebels pounded army posts and checkpoints in Harem, the troops withdrew to the citadel that later fell in the hands of rebels.

Rami-Abdul-Rahman, who heads to Observatory, said nearly 30 soldiers and pro-government gunmen surrendered late Monday. He added that rebels set free all gunmen at the age of 16 or less and referred others to local tribunals.

"Harem was very important because it is one of the towns that was loyal to the regime," Abdul-Rahman said by telephone about the town that is nearly a mile from the Turkish border.

In his traditional Christmas address, Pope Benedict XVI decried the slaughter of the "defenseless" in Syria, where anti-regime activists estimate more than 40,000 have died in fighting since the uprising against President Bashar Assad's rule began in March 2011.

The pope encouraged Arab spring nations, where long-serving dictators were forced to step down.

In Aleppo province, which neighbors Idlib, local activist Mohammed Saeed said rebels attacked a military base in the town of Mannagh near the border with Turkey. He said it is one of four air bases in the province.

Regime forces have been using helicopters to carry supplies to besieged areas and to attack rebel positions.

The regime has had increasing difficulty sending supplies by land to Aleppo province after rebels captured in October the strategic town Maaret al-Numan. The town is on the highway that links Damascus with Aleppo, Syria's largest city and commercial center and a major battleground in the civil war since July.

"Airplanes and helicopters are the only way to send supplies since the Free Syrian Army controls the land," Saeed said. He added that rebels are also laying a siege to Aleppo's international airport known as Nairab and threatening to shoot down military or civilians planes using it.

In the Damascus suburb of Jaramana, opposition gunmen ambushed the head of military intelligence in the area and seriously wounded him. He later died of his wounds, the Observatory said.

In Israel, top officials said they cannot corroborate Syrian activists' claims that the regime has used chemical weapons against its citizens.

Vice Premier Moshe Yaalon told Army Radio that Israel has "no confirmation or proof" the regime has employed such weapons in the civil war. He says Israel is "monitoring the situation with concern."

Defense Ministry official Amos Gilad told Israel Radio that Syria was closely guarding its chemical weapons stockpiles.

On Monday, the Observatory quoted activists in the central city of Homs as saying that six rebels died in two neighborhoods the day before after inhaling white smoke that came out of shells fired by government troops in the area. Amateur videos released by activists showed men in hospital beds suffering breathing problems as doctors placed oxygen masks over their faces.

(AP) ? It's hardly a secret that Barack Obama, like every president no doubt, muses about his ultimate legacy and spot in the presidential pantheon. He approaches his second term confronting tough and shifting challenges that will play big roles in shaping the rest of his presidency and his eventual place in history.

In the coming months, Obama will have to decide where to be ambitious, where to be cautious, and where to buy time.

He draws political strength from his surprisingly easy re-election in a bad economy. It's partly offset, however, by Republicans' continued control of the House, plus their filibuster powers in the Senate.

Some of the big issues awaiting the president's decisions are familiar, long-simmering problems. They include immigration and the need for a tenable balance between taxes, spending and borrowing.

Another issue, gun control, jumped to the national agenda's top tier this month following the massacre of first-graders and teachers in a Connecticut school. And the issue of climate change remains unresolved.

Veteran politicians and presidential historians say it's almost impossible for Obama to "go big" on all these issues. Indeed, it might prove difficult to go big on even one. While some counsel caution, others urge the president to be as bold and ambitious as possible.

"Americans are yearning for leadership," said Gil Troy, a presidential scholar at McGill University.

As a president dealing with policy, he said, Obama has generally failed to give "that visionary, powerful address that we came to know and love and expect in the 2008 campaign."

Rather than let Congress take the lead on big issues, as it did in drafting the 2009 health care overhaul, Obama should be more forceful in pushing new legislation or using his executive powers to bypass Congress where possible, Troy said.

"The gun control issue is a major opportunity for Obama to make his mark on history -- and solve a problem that has frustrated Democrats for decades," he added.

Other presidential historians, however, think Obama is severely constrained by political realities. They say he will have to carefully pick and choose which goals to emphasize in his second four years.

"I see Obama as almost uniquely handcuffed by circumstances," said John Baick of Western New England University. The number of big, unresolved problems facing the nation, coupled with a deeply divided public and Congress, he said, leave Obama with fewer viable options than most presidents have enjoyed.

At best, Baick said, the U.S. government "is a gigantic cruise liner, and the most he can do is keep us from hitting icebergs."

For instance, Baick said, "if he goes big on gun control, then it's 1994 all over again."

Then-President Bill Clinton pushed an assault weapons ban through the Democratic-led Congress that year, prompting fierce pushback from gun-rights groups. Clinton later would credit the NRA with shifting the House majority to the GOP for the first time in 40 years. However, other factors ? including a House bank scandal ? played big roles, too.

Paul Rego, a political scientist at Messiah College in Grantham, Penn., largely agrees with Baick.

"While President Obama does not face the same cataclysmic events that Abraham Lincoln faced, or that FDR encountered in the form of the Great Depression and World War II, his challenges are many and significant," Rego said in an email.

He said Obama "faces a hurdle that neither Lincoln nor Roosevelt had to overcome during the tumultuous years of their respective presidencies: divided government." Today's Democrats and Republicans differ so sharply about government's proper role, Rego said. He said that Obama's job "is actually harder than that of his most illustrious predecessors."

Politicians of all stripes say Obama's first priority is to resolve the deep partisan divide over tax-and-spending issues, exemplified by repeated impasses over two years that led to this week's showdown on the "fiscal cliff."

An even higher-risk conflict may arise in a few months. Congress again must either raise the federal debt ceiling or see the government default on its loans.

Beyond that, lawmakers and interest groups are watching for signs of how hard Obama might push to restrict firearms and expand illegal immigrants' rights.

Obama said last Wednesday that gun control will be a central issue in his second term. "I will use all the powers of this office to help advance efforts aimed at preventing more tragedies like this," he said of the Sandy Hook Elementary School mass killings.

The president named an interagency task force to recommend anti-violence legislation within weeks. The strategy gives him room to distance himself somewhat from its recommendations if he wants, even though he named Vice President Joe Biden to chair the panel.

Americans' affinity for firearms runs deep, and many political activists think Obama could have more sweeping success with immigration changes.

He won a big majority of Hispanics' votes in both his elections. The trend alarms Republican strategists, who fear their party won't win another presidential election until it repairs its bad relations with Latinos.

With Democrats and Republicans increasingly aware of Hispanics' growing political clout, "this might be an historic opportunity," Troy said.

Chris Dolan, a political scientist at Lebanon Valley College in Pennsylvania, agrees. He said he expects Obama to be "incredibly ambitious on comprehensive immigration reform."

The effort, Dolan said, could "build a lasting Democratic support group. You can't do that with gun control."

Still, opposition to granting citizenship to illegal immigrants runs deep in many circles, especially the Republican Party's base. Bids for "comprehensive immigration reform" have gone nowhere in Congress in recent years.

Several advocacy groups want Obama to make the most of his executive powers to enact measures that don't require congressional action.

The Migration Policy Institute earlier this year made several suggestions regarding immigrants. They included "establishing uniform enforcement priorities," defining "what constitutes effective border control," and "allowing applicants for immigrant visas to file in the United States."

Now that Obama has won re-election, however, the advocacy group wants him instead to push a broader agenda through Congress.

"With the issue teed up for possible action," said Doris Meissner, a former commissioner at the U.S. Immigration and Naturalization Service, antagonizing congressional Republicans with executive actions "would not be politically smart."

The political climate for sweeping immigration changes "is significantly better," Meissner said, "but that does not mean it will happen."

Even with a full plate of challenges and a hostile party controlling the House, she said, "I think Obama absolutely has to go big on immigration."

The White House has declined to detail the president's plans for a second-term agenda. Once the deficit-spending problems known as the "fiscal cliff" are addressed, said White House spokeswoman Jamie Smith, "President Obama looks forward to working on a number of issues that are critical to our future, from immigration to energy, to education and national security direction."

There?s no doubt the smartphone has changed the world, and maybe even more than once. As soon as it hit our hands, it was a huge success. No longer were we limited by the already incorporated features that came with the shipped phone. We could now download applications that further expanded the features on our smartphone. Suddenly the features available were only limited to the hardware that supported them, which in theory, is only limited to our imagination. But what now? We have the smartphone, but now we don?t know where to put it. It?s either too big or too fragile. Well, there are some people in the world who want to make the denim smartphone pocket a standard on all jeans. Is it a good idea?

The smartphone pocket idea comes from a company called I/O Denim, and it is a pretty straight forward idea really. How many times have you struggled when trying to get your smartphone out of your jeans pocket? I would say a bunch of times, right? The I/O Denim solution is to put a smartphone pocket on the left-hand side of the jean?s seam. Within an arm?s reach, you?ll have a much simpler and straight forward way to get access to your smartphone.

Not much needs to be said about this concept other than that it?s a great one. The smartphone pocket idea is another thing that is currently in its startup phase. Just like almost all other startups, the I/O Denim project is raising funds on Kickstarter in order to secure their first shipment. They are looking to raise $10,000 to fund their project, and with only 7 days left and just $5,800 raised, it?s now up to us whether or not this will become a part of our future. Do you feel you are in need of a smartphone pocket? Would it make your life simpler? Heck yeah! My humble opinion is that if it can keep us from having unnecessary accidents and allow us easy access to our smartphones, it?s a solution worth trying. What is your opinion?

Israel says Syria chemical weapons are secure for now

JERUSALEM (Reuters) - Syria's chemical weapons are still secure despite the fact that President Bashar al-Assad has lost control of parts of the country, a senior Israeli defense official said on Sunday.

Amos Gilad told Army Radio that the civil war between Assad and opposition forces fighting to topple him had become deadlocked, but that the Syrian leader showed no signs of heeding international calls to step down.

"Suppose he (Assad) does leave, there could be chaos ... in the Middle East you never know who will come instead. We need to stay level-headed; the entire world is dealing with this. At the moment, chemical weapons are under control," Gilad said.

As Syria's southern neighbor, Israel has been concerned about chemical weapons falling into the hands of Islamist militants or Lebanese Hezbollah fighters, warning it could intervene to stop such developments.

Western countries said three weeks ago that Assad's government might be preparing to use poison gas to repel rebel fighters who are encamped around Damascus, the capital, and who control rural Aleppo and Idlib in the north.

"The opposition is not managing to defeat him and he is not defeating the opposition, though more and more parts of Syria are no longer under his control and that is what matters," Gilad said.

The rebels - mainly Sunni Muslims - are pushing southwards from their northern strongholds into the central province of Hama.

But Assad, who is from the Alawite minority linked to Shi'ite Islam, has responded with artillery, air strikes and, according to NATO, with Scud-type missiles.

Western powers and some Arab countries have called for Assad to step down, but Russia's Foreign Minister Sergei Lavrov said on Saturday that international efforts to persuade Assad to quit would fail.

Lavrov said Russia had rejected requests from countries in the region to pressure Assad to go or to offer him safe haven. If Assad did exit the political scene, it could lead to an upsurge in the fighting that activists say has killed 44,000 people since the uprising began in March 2011, Lavrov said.

23 scientists and innovators win medals

President Barack Obama has named 12 researchers and 11 inventors as recipients of the federal government's highest honors in their fields: the National Medal of Science, and the National Medal of Technology and Innovation.

The newly named recipients will receive their awards at a White House ceremony next year.

"I am proud to honor these inspiring American innovators,"?Obama said today in a White House statement. ?"They represent the ingenuity and imagination that has long made this nation great ? and they remind us of the enormous impact a few good ideas can have when these creative qualities are unleashed in an entrepreneurial environment."

The National Medal of Science was established in 1959 and is administered for the White House by the National Science Foundation. The National Medal of Technology and Innovation was created in 1980, under the auspices of the Commerce Department's Patent and Trademark Office. Committees select nominees for each of the medals?? the science medal for contributions to research, and the technology medal for contributions to American competitiveness and quality of life.

National Medal of Science recipients include:

  • Allen Bard, chemist focusing on artificial photosynthesis, University of Texas at Austin
  • Sallie Chisholm, biologist focusing on marine organisms, Massachusetts Institute of Technology
  • Sidney Drell, physicist and arms control expert, Stanford University

Miami Valley Gaming Finalizes Lebanon Sale

Miami Valley Gaming & Racing, a joint venture of Delaware North Companies Gaming & Entertainment and Churchill Downs Incorporated, announced Dec. 21 that it has completed its purchase of the harness racing licenses and certain assets held by Lebanon Trotting Club Inc. and Miami Valley Trotting Inc.

The closing on the purchase of Lebanon Raceway in Lebanon, Ohio and recent state and local approvals pave the way for construction to begin on a new gaming and racing facility located near exit 29 off of Interstate 75 between Cincinnati and Dayton. The new facility is expected to open in the first quarter of 2014.

"We are pleased to be moving forward with this significant economic development project that is expected to add $24 million a year to the local economy and create 1,000 construction jobs and 700 permanent jobs in southwestern Ohio," said William Bissett, president of Delaware North Companies Gaming & Entertainment.

Bill Carstanjen, CDI's president and chief operating officer, added, "We appreciate the hard work of everyone involved, including the Ohio State Racing Commission and the Ohio Lottery Commission, to complete the necessary steps for us to build this new, world-class gaming and racing facility that we expect will be another great entertainment destination in Ohio."

When construction of the new venue is completed, harness racing and simulcast operations will move from the current location at the Warren County Fairgrounds to the new gaming and racing complex on the northeast corner of Union Road and State Route 63 in Turtle Creek Township in Warren County. The joint venture finalized the acquisition of the land with the Ohio Department of Administrative Services Dec. 20.

The new facility will include a five-furlong harness racing track and a 186,000-square-foot gaming facility, featuring up to 2,500 video lottery terminals on the 120-acre site. The Warren County Board of Commissioners approved the planned use development for the new facility in October. Miami Valley Gaming & Racing will invest approximately $215 million, including the $50 million license fee payable to the Ohio Lottery Commission.

The purchase was contingent upon the approval of the partnership's respective applications to the Ohio Lottery Commission and the Ohio State Racing Commission. The Ohio State Racing Commission approved the joint venture's racing license and application to relocate the raceway Dec. 13. The Ohio Lottery Commission conditionally approved Miami Valley Gaming & Racing's application for its video lottery sales agent license Dec. 19.

Racing and simulcasting will continue at the Warren County Fairgrounds facility until construction of the new facility is complete.
